Effective Legal Solutions WHEN ADDRESSING ALIMONY

Alimony & Spousal Support

When Alimony/Spousal Support is mentioned it can often lead to strongly contradicting opinions and preferences amongst a divorcing couple.

At the Law Offices of James M. Lilly, we are committed to providing exceptional representation to ensure that clients either receive what they should or do not pay more than they should.

What are the Four Types of Alimony in Florida?

In Florida, there are four types of Alimony.

  • Temporary Alimony happens during the divorce process. It is intended to provide financial support during the pendency of the case to a spouse who is in need of financial support.
  • Bridge-the-gap Alimony is awarded at the conclusion of the divorce and is for a plan to help the spouse adjust to their new financial circumstances.
  • Rehabilitative Alimony is to assist a spouse in education and acquiring skills to enable them to re-enter the workforce and become self-supporting.
  • Durational Alimony is to support a spouse long-term and is based upon the length of the marriage and the difference in income between the parties.

What can I expect to pay in Alimony?

The law does not have a clear calculation for Alimony/Spousal support in the same way it does for Child Support. Additionally, Alimony may not be awarded depending on the particular circumstances of your case.

Therefore, it is critical to speak with an experienced attorney such as James M. Lilly to determine whether Alimony is appropriate in your case and what partiular types of alimony may be sought by either you or your spouse.

What about Modifying or Terminating an Existing Alimony Obligation?

In nearly all cases, there are certain circumstances that may take place at a later date under which an alimony obligation can be changed.

Whether it is a change in employment, inheritance, re-marriage, or a retirement, it is important to share the unique circumstances of your case with an experienced attorney to determine the potential upside of seeking to change your existing alimony/spousal support obligation.
